Ms. Jane Kimani, the wife of former Murang’a Governor Mwangi Wa Iria, alongside her brother Solomon Kimani, found themselves under legal scrutiny for their alleged involvement in the misappropriation of Sh140 million from the county government.
Appearing before Chief Magistrate Thomas Nzioki, the two suspects refrained from entering a plea as another court intervened to halt their prosecution.
The proceedings to charge them were abruptly halted following a directive from the Murang’a High Court.
Defense counsel Wilfred Nyamu apprised the Nairobi court of the petition filed by the accused parties in a neighboring county’s court.
He presented a copy of the ruling issued by Justice Cecilia Githua from the Murang’a High Court’s Constitution and Human Rights Division.
In her ruling, Justice Githua issued orders restraining the Director of Public Prosecutions, the Inspector General of Police, the Ethics and Anti-Corruption Commission (EACC), and the Directorate of Criminal Investigations from arresting or prosecuting the accused pending the determination of the petition.
“Pending the hearing and determination of that petition by the three applicants interim orders staying and restraining the respondents by either themselves or agents from implementing the DPP’s decision contained in his letter dated April 13, 2024,” Justice Githua’s ruling stated.
State prosecutor Jeremiah Walusala acknowledged receipt of Justice Githua’s orders but noted that they only applied to the two primary accused individuals, not the seven co-accused.
Consequently, the prosecution sought a warrant for the arrest of the seven co-accused who failed to heed summons to appear before the EACC on Wednesday for processing prior to their arraignment.
